Terms of Service for MyCache

Welcome to MyCache. These Terms of Service (“Terms”) govern your access to and use of MyCache, including any related websites, mobile applications, and services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

1. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18 (or under the age of majority in your jurisdiction), you may only use the Service under the supervision of a parent or guardian who agrees to be bound by these Terms.

You can disable location sharing at any time in your device or browser settings, though doing so may limit certain Service functionality. MyCache is not responsible for the accuracy or completeness of location data.

5. User-Generated Content

You are solely responsible for any content you post, upload, or submit to the Service (“User Content”). You agree not to post User Content that:

  • Is unlawful, obscene, defamatory, or otherwise objectionable.
  • Infringes any intellectual property or privacy rights.
  • Contains malware, viruses, or any harmful code.

By submitting User Content, you grant MyCache a non-exclusive, royalty-free, worldwide, irrevocable license to use, copy, modify, distribute, display, and perform your User Content in connection with operating the Service.

6. Intellectual Property

All content made available through the Service—such as text, graphics, logos, images, software, and other materials—is the property of MyCache or its licensors and is protected by applicable intellectual property laws. You may not use, copy, or distribute any such content without prior written consent from MyCache or the respective rights holder.

7. Privacy

Your use of the Service is also subject to our Privacy Policy, which explains how we collect, use, and protect your data, including location data. By using the Service, you consent to these practices.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, secure, or that any defects will be corrected. Your use of the Service is at your sole risk.

9. Limitation of Liability

To the fullest extent permitted by law, MyCache and its affiliates, officers, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for lost profits, goodwill, data, or other intangible losses, arising out of or related to your use of (or inability to use) the Service, even if advised of the possibility of such damages.

10. Indemnification

You agree to defend, indemnify, and hold harmless MyCache and its affiliates from and against any claims, damages, liabilities, losses, or expenses (including attorney’s fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your access to the Service at our sole discretion, with or without notice. Upon termination, your right to use the Service ceases immediately.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of Texas, without regard to conflict of law provisions. Any disputes arising from these Terms shall be resolved exclusively in the courts of Texas.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice before the new terms take effect. By continuing to use the Service after changes become effective, you agree to be bound by the revised Terms.
